Negligent Driving

Negligent Driving in the first degree occurs if a person drives a vehicle in a way that is negligent and endangers or is likely to endanger a person or property and the driver exhibits the effects of having consumed alcohol or an illegal drug. Sometimes a DUI charge will be amended or reduced to a Negligent Driving charge. Negligent Driving in the second degree happens when one operates a vehicle in a way that is negligent and endangers or is likely to endanger person or property but that does not amount to circumstances of Negligent Driving in the first degree.
